What's Grafetee Grafetee is an easy way to post location based status updates either to Facebook or anonyously to everyone. It's like writing tags to walls for others to read. How much does Grafetee cost? Our app is and will always be free. Do I need to register to use the app? No you don't. You can use the app completely anonymously and without registration. You can link your Facebook account to it if you want to post location based updates to your Facebook friends but you don't have to do that unless you want to. You can link and unlink for Facebook account easily for each message so that you can switch from anonymous to Facebook account in a second. How does privacy work in Grafetee? Grafetee is totally public and everyone is able to see all posts. The posts are always anonymous unless you decide to sign them with your nickname or reveal other personal information in your posts. If you link Grafetee with your Facebook account, then posts to Grafetee will still be anonymous but your Facebook friends will see your posts in your Facebook wall. With a single tap you can select if the posts witten with Graffetee appear on your Facebook wall (=your friends can see them) or not (=totally anonymous) Does Grafetee need to know my location to work? Yes. Grafetee is totally location driven and doesn't work unless we know where you are. We do not track your movements and neither do we store your location information. We just use it to locate your post or find you content that is created close by. How do I delete posts I have taken? You can delete your own posts using the app by pressing the "x" mark after each of your messages. What do I do if I see inappropriate content? Let us know at moderator@Grafetee.com. We'll be working on automatic filters and other means to keep inappropriate content to a minimum. Which phones and operating systems do you support? At the moment we support all iPhones, iPods and iPads with iOS 4.0 or higher but we don't have a dedicated app for iPad. A general HTML5 app works accross all devices with a HTML5 enabled browser. GRAFETEE PRIVACY POLICY (last updated August 18, 2011) This is Grafetee privacy policy. Your phone is Device and our Grafetee application is App. This website (www.grafetee.com) is Site. WHAT WE COLLECT WHEN YOU DOWNLOAD AND USE OUR APP: We collect the comments you leave through the App ("Content"), and information on your location. When you use our App, your Device provides us with your location using global positioning technology, wireless networks or mobile data networks ("Location Data"). The Location Data allows us to identify your location in order to show you Content based upon where you are at that moment. We share your Content with others who have access to the App, and you may also share your Content by posting it to third party sites. Sharing Content publicly with others from different locations is what this App is about. If you find this objectionable, please consider not using our App. WHAT WE SHARE WITH OTHERS: We store and share with other users of the App the Content you post using the App and the location from which your Content was created. Our App also allows you to share your name and Content on some social media sites if you so choose. If you choose to use this function, we neither store nor share the information you input to access those sites through our App. WHAT WE COLLECT WHEN YOU ACCESS OUR SITE: The usual stuff. Like most online companies, we capture your browser and operating system information, and your IP address. We also collect cookies, which are tiny data files your computer sends us. We use cookies to customize your experience on our Site. If you want to disable the cookies, follow the directions on your browser. DISCLOSURE TO OTHERS: Other than what we've stated in this policy, we don't disclose your information to anyone. Keep in mind if there is a change of our ownership, or we acquire another company, the new entities will have the same information we have. Also, if we receive a valid court order, or the law otherwise requires us to disclose it, or we're alerted to extremely offensive behavior, we may disclose your information or Content. Finally, if you do something illegal on our Site, and we are made aware of it, we may turn your information over to law enforcement. USE BY MINORS: The App and Site are not intended for people under the age of 13. We encourage minors over the age of 13 to seek permission from their parents before using our App and Site. PROPER BEHAVIOR: When using our App do not use offensive language. We will remove any Content that is not appropriate and will report Content that might violate the law to proper authorities. GRAFETEE TERMS OF SERVICE GENERAL. Grafetee mobile application ("App") and the website www.grafetee.com ("Site") are owned and operated by Kat Hed Inc. The App runs on different smartphones ("Device"). This Terms of Service agreement applies any time you use our App or visit our Site. By using our Service, you agree to these terms. OUR SERVICE. The App is designed for content sharing. It functions as a place to view and share location based comments ("Content"), posted either anonymously or using your Facebook credentials if you so choose. When you open our App, it immediately finds your location. You'll see Content posted to the service by other users close to your location. If you choose to post Content using the App, other nearby users will see your Content on their Devices. While you are using the App, wherever you go, you'll see the Content of other users who are geographically close by. The Content you see on your Device may also viewable through various social media outlets if you choose to post the Content to them. OUR AUDIENCE. Our Service is intended for use by people who are 13 years of age or older. Minors over the age of 13 should seek permission from their parents to use the App or Site. YOUR CONTENT IS PUBLIC. When you create Content using our App, that Content is immediately published to anyone who has the App, although it is most likely seen by users close to your location. Please do not use our App to create Content that would be inappropriate for some viewers, or Content that advocates illegal activity, and things of that nature. We ask that you don't make comments or really do anything that would be unsuitable to share in a public environment. If in our sole discretion your Content violates our Terms of Service, we reserve the right to remove it and/or disable the App on your Device permanently. If we do disable the App, you will be permanently barred from using our Service. You can also report Content that you believe violates this If you remove Content, that Content is no longer viewable in the App. USE OF SERVICE. Don't use our Service to do things that are illegal. Don't use our Service for commercial purposes. Don't impersonate someone else. Don't use our Service in any way to harass, bully, stalk, or harm others or violate their privacy rights. Don't use our Service to encourage harassment, bullying, or other inappropriate behavior. Don't use our Service to defame, slander, or advocate hateful practices, like advocating racism, bigotry, illegal acts, and acts of violence or terrorism. Don't use our Service to disclose confidential or personal information about anyone. If in our discretion, you have engaged in these or other objectionable acts, and we find out about it, we will permanently disable our App on your Device and remove any questionable Content. LAW ENFORCEMENT. If we're alerted to something we believe warrants law enforcement's involvement, we may report it. YOU OWN THE CONTENT YOU CREATE. Whatever Content you create using our App is yours, but a copy will be published instantly within the App and it may quickly go viral. If you didn't create the Content, you may view it (and share it), but you don't own it. That means you cannot use it without permission. If you did create the Content, and you want to give someone permission to use it, that is your right. YOU GRANT US A LICENSE. You don't have to use our Service, but if you do, you're giving us permission to use your Content. By using our Service, you automatically grant (and you represent and warrant that you have the right to grant) to us: (a) a royalty-free, worldwide, fully paid-up, perpetual, irrevocable, non-exclusive right and license to (i) store, use, license and sub-license reproduce, distribute, modify, adapt, and publicly display your Content within the Site and in the App, individually or as part of a compilation; and (ii) use, license and sub-license and reproduce any of your Content in any or all media throughout the world for the purpose of transmitting or publicizing the App; (b) the perpetual and irrevocable right, but not the obligation, to delete any or all of your Content from the App and from the Site, whether intentionally or unintentionally, and for any reason or no reason, without notice or any liability of any kind to you or any other party; and (c) a royalty- free, fully paid-up, perpetual, irrevocable, non-exclusive right and license to copy, analyze and use any of your Content as we may deem necessary or desirable for purposes of debugging, testing and/or providing support services in connection with the App or the Site. NO GUARANTEES. Our App and Site are provided on an "as is" and "as available" basis and we expressly disclaim all warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any direct, indirect, incidental, special, or consequential damages (including attorneys' fees and lost profits or savings) to you connected with use of this App or Site, including its Content, and regardless of any negligence by us. We do not guarantee that the functions contained on the Site or in the App will be uninterrupted or error-free, or that the App, the Site, or our servers will be free of viruses or other harmful components, or that defects will be corrected even if we are aware of them. We trust you understand that we disclaim all responsibility for any loss, injury, claim, liability, or damage of any kind resulting from, arising out of, or in any way related to: (1) any errors in or omissions from the App, Site, EULA, Privacy Policy, or TOS, including but not limited to technical inaccuracies and typographical errors; (2) any information about this App or Site posted by any 3rd party, including without limitation, information posted on any related blog; (3) the unavailability of this App or Site; 4) your use of the App or Site; or (5) your use of any equipment or software in connection with the App or Site. JURISDICTION. When you use the App or Site, you are agreeing that, unless where prohibited, your use shall be governed by and construed in accordance with the laws of Finland. GRAFETEE END USER LICENSE AGREEMENT THIS IS A LEGAL AGREEMENT BETWEEN YOU AND Grafetee ("Grafetee"), stating the terms that govern your use of the Grafetee application ("Licensed Application"). This agreement, together with all updates, additional terms, software licenses, and all of Grafetee's rules and policies, collectively constitute the "agreement" between you and Grafetee. By installing the Licensed Application you are indicating that you agree to these terms. If you do not agree to these terms do not install or use the application. You must accept and abide by these terms as presented to you. Changes, additions, or deletions are not acceptable, and Grafetee may refuse access to the Licensed Application for noncompliance with any part of this agreement. The Licensed Application is licensed, not sold, to You for use only under the terms of this license, unless accompanied by a separate license agreement issued by Grafetee, in which case the terms of that separate Grafetee license agreement will govern. Licensor (hereinafter, "Licensor" or "Grafetee") reserves all rights not expressly granted to You. This license granted to You for the Licensed Application by Grafetee is limited to a non-transferable license to use the Licensed Application on any supported smartphone ("Device") that You own or control and as permitted by the Usage Rules set forth in Section 9.b. of the App Store Terms and Conditions (the "Usage Rules"). This license does not allow You to use the Licensed Application on any product that You do not own or control, and You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer in any form (including rent, lease, lend, sell, redistribute or sublicense) the Licensed Application. You may not copy (except as expressly permitted by this license and the Usage Rules), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any parts of updates, except regarding use of open source elements components included with this Licensed Application). Any attempt to do so is a violation of the rights of Grafetee and its licensors. If You breach this restriction, You may be subject to prosecution and damages. The terms of the license will govern any upgrades provided by Grafetee that replace and/or supplement the original product, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern. By using this Licensed Application, you acknowledge that the Licensed Application may collect and use personal data, technical data and related information, including but not limited to your Device's location, technical information about Your Device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to You (if any) related to the Licensed Application. Grafetee may use this information, as long as it is in a form that does not personally identify You, to improve its products or to provide services or technologies to You. You also understand that full use of this Licensed Application may require you to register on the Grafetee website, and that personally identifiable information may be collected by Grafetee, consistent with its privacy policy. The license is effective until terminated by You or Grafetee. Any rights granted herein are subject to termination with or without notice from Grafetee if You violate and/or fail to comply with any terms or conditions set for herein. Once this license is terminated, You are no longer entitled to use the Licensed Application. You shall cease all use of the Licensed Application, and destroy any legally made copies or portions thereof, of the Licensed Application. This Application should be used responsibly, safely, and only for the purposes intended by Grafetee. The Licensed Application enables access to Grafetee's and third party services and web sites, and may even include GPS locator websites (collectively and individually, "Services"). Use of the Services may require Internet access and may further require that You accept additional terms of service. You understand that by using any of the Services, You may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified, and that the results of any photo search or entering of a particular URL on any website may automatically and unintentionally generate links or references to objectionable material. Nevertheless, You agree to use the Services at Your sole risk and that Grafetee shall not have any liability to You for content that may be found to be offensive, indecent, or objectionable. You acknowledge and agree that Grafetee is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of any Content or comments used or web sites. Grafetee does not warrant or endorse and does not assume and will not have any liability or responsibility to You or any other person for any Services, Third Party Materials or web sites, or for any other materials, products, or services of third parties. Third Party Materials and links to other web sites are provided solely as a convenience to You. In addition, third party Services and Third Party Materials that may be accessed from, displayed on or linked to from the iPhone, IPad, or iPod Touch are not available in all languages or in all countries. Grafetee's intended service area is the Continental United States for residents who can reasonably use Grafetee services. If You do not qualify as an intended customer, do not download this application. Grafetee makes no representation that identified Services and Materials accessible outside of its intended coverage area are appropriate or available for use in any particular location. To the extent You choose to access such Services or Third Party Materials, You do so at Your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. Grafetee, and its licensors, reserves the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will Grafetee be liable for the removal of or disabling of access to any such Services. Grafetee may also impose limits on the use of or access to certain Services, in any case and without notice or liability. You understand that Grafetee may offer integration with its own and/or with third party Services for your convenience. The Licensed Application allows you to post Content that are made public. By using the Licensed Application, you grant (and you represent and warrant that you have the right to grant) to Grafetee: (a) a royalty-free, world-wide, fully paid-up, perpetual, irrevocable, non-exclusive right and license to (i) store, use, reproduce, distribute, modify, adapt, and publicly display your Images within the Site and in the Grafetee Environment, individually or as part of a compilation and (ii) use and reproduce any of your Images or comments in any or all media throughout the world for the purpose of transmitting or publicizing the App or Grafetee; (b) the perpetual and irrevocable right, but not the obligation, to delete any or all of your Images and/or comments from the Grafetee servers and from the Site, whether intentionally or unintentionally, and for any reason or no reason, without any liability of any kind to you or any other party; and (c) a royalty- free, fully paid-up, perpetual, irrevocable, non-exclusive right and license to copy, analyze and use any of your Images and comments as Grafetee may deem necessary or desirable for purposes of debugging, testing and/or providing support services in connection with the App or the Site. You expressly acknowledge and agree that use of the Licensed Application is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. To the maximum extent permitted by applicable law, the Licensed Application and any Services performed or provided by the Licensed Application are provided "as is" and "as available," with all faults and without warranty of any kind, and Grafetee hereby disclaims all warranties and conditions with respect to the Licensed Application and any Services, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and non-infringement of third party rights. Grafetee does not warrant against interference with your enjoyment of the Licensed Application in any way, or that defects in the Licensed Application or Services will be corrected. No information or advice given by Grafetee representatives shall create any warranty. Should the Licensed Application or Services prove defective, you assume the entire cost of all necessary servicing, repair or correction. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusion and limitations may not apply to you. To the extent not prohibited by law, in no event shall Grafetee be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use the Licensed Application, however caused, regardless of the theory of liability (contract, tort or otherwise), even where Grafetee has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you. In no event shall Grafetee's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of Fifty Dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose. The laws of Finland, excluding its conflicts of law rules, govern this license and your use of the Licensed Application.
